MOTIV PRIVACY POLICY

Introduction 

Your privacy is important to us. Accordingly, WHAT’S YOUR MOTIV LLC (“Motiv”, “we”, “our”, “us”) has developed this privacy policy (the “Privacy Policy”) which describes the types of personal data and information we may collect from users (“you”) who access or use our website, https://www.themotivapp.com/, or our app, (the “Platform”), and our practices with respect to the collection, storage, use, transfer, disclosure, and protection of this information.

If you do not agree with our policies, your choice is to not use the Platform. By using the Platform, you agree to the terms and conditions of this Privacy Policy, as they may change from time to time. Your continued use of the Platform after we make any changes is deemed to be an acceptance of those changes.

Children’s Privacy 

We collect personal data from children under the age of 13 only with verifiable parental consent. Information We Collect 

We collect two types of personal data: (1) data collected automatically; and (2) data you provide to us. Data automatically collected by us may include, but is not limited to, your IP address, geographic location (as determined by your IP address or as authorized by your device settings), browser type and version, hardware and software specifications, device-related information, interactions such as clicked links within the Platform or communications, content accessed or viewed within the Platform (including but not limited to Motiv calendar entries you create or view within the Platform, messages, and profile views), session duration, access timestamps, and Platform performance metrics. Additionally, we may collect your shipping and/or residential address for purposes related to store functionalities. Data you provide may include your name, age, date of birth, sex, gender, email address, phone number, and address. This data is collected when you create an account, complete forms, or otherwise engage with the Platform.

For purposes of this Privacy Policy, personal data or information does not include aggregated, anonymous, or deidentified information, or information that does not personally identify you. This information is not linked to personal information and cannot be used to identify a particular person.

How We Use Your Data 

The data we collect is used for a variety of purposes including, but not limited to:

(i)      Presenting the Platform and its contents to you; 

(ii)     Providing you with information, products or services that you request from us; 

(iii)    Keeping you updated on our latest product announcements and upcoming events; 

(iv)    Creating, developing, operating, delivering, and improving our products, services, content and advertising; 

(v)     Addressing product or service concerns and for loss prevention and anti-fraud purposes; 

(vi)    For internal purposes such as auditing, data analysis, and research to improve our products, services, and customer communications; 

(vii)   To allow you to interact with the Platform; 

(viii)  In any other way described when you provide the information; and 

(ix)    For any other purpose with your consent.

Additionally, the information helps us manage user accounts, process requested transactions, and enhance your user experience. Data collected automatically may also be used to improve the functionality of the Platform and ensure security.

Payment Processing & Third-Party Providers 
We accept payments for merch and services using InkSoft’s payment processing platform, which may be powered by a third-party payment processor (e.g., Payrix or similar provider). We do not store payment card details on our servers — all payment data is processed securely by InkSoft’s processor under industry-standard practices. 

When you make a purchase, your payment information is collected by InkSoft’s payment processor and subject to their privacy and security practices. Please review InkSoft’s payment privacy terms for details on how they handle and protect your payment data.

Sharing and Disclosure to Third Parties 

Google Calendar Integration (Google User Data) 
If you choose to connect your Google Calendar to the Platform, we use Google OAuth to obtain permission to send Motiv events to your Google Calendar. 

 

What we do (and do not do) 
We do not read your Google Calendar events (including event titles, descriptions, attendees, or other non-Motiv events) for the calendar sync feature. We only create, update, and delete calendar events that originate in Motiv (“Motiv Events”) on your Google Calendar. 

 

What Google data we access/receive 
To create and manage Motiv Events in Google Calendar, Google provides technical responses that may include limited metadata such as the Google Calendar event ID for the event we created or updated, along with status or confirmation fields. We use this information solely to maintain the sync and ensure we only modify or delete Motiv Events. 

 

How we use Google data 
We use the Google Calendar integration solely to: 

  • Create Motiv Events in your Google Calendar; and 

  • Update or delete those Motiv Events in your Google Calendar when you edit or delete them in Motiv. 

 

How we store Google data 

We store only what is necessary to operate the integration, such as: 

  • OAuth tokens (access and refresh tokens) required to send events to Google Calendar; and 

  • A mapping between Motiv event identifiers and the corresponding Google Calendar event IDs for Motiv Events, so that we can update or delete only the events created by Motiv. 

 

Data retention 
We retain Google authorization tokens and Motiv Event–to–Google event ID mappings until you disconnect Google Calendar, delete your Motiv account, or request deletion. After disconnection, we delete or de-identify stored Google sync data within a commercially reasonable period, except where retention is required for security, fraud prevention, legal compliance, or dispute resolution. 

 

Sharing 
We do not sell Google user data. We do not share Google user data with third parties except with vetted service providers that help us operate the Platform (e.g., hosting and security) under confidentiality and security obligations, or where required by law. 

 

Limited Use 
Motiv’s use and transfer of information received from Google APIs will comply with the Google API Services User Data Policy, including the Limited Use requirements. Google for Developers+1 

 

User controls / revoking access 
You can disconnect Google Calendar at any time in Motiv (if available) and/or revoke Motiv’s access in your Google Account permissions. Disconnecting stops further syncing. You may also request deletion of integration data by contacting us at Connect@theMotivapp.com

We do not sell your personal information to third parties for any reason. We may share information we collect about you with business partners that work with us to provide products and services, perform market analytics, or to help us market to current and potential customers.

We may share aggregated, anonymous demographic information that we gather in accordance with this privacy notice without restriction.

Additionally, we may share personal data in order to comply with any lawful court order, law, legal proceedings, inquiries made by governmental or regulatory agencies, as well as to protect our rights, or in the event of a business transaction like a merger or sale of business assets.

Other Websites 

The Platform may contain links to other websites that are not associated with us (“Third Party Websites”). Information collected about you on Third Party Websites is covered by the privacy policies on those websites, and not this Privacy Policy. We encourage you to review the respective privacy policy on Third Party Websites before using or entering any personal information on those websites, and to fully consider the risks associated with using or entering your personal information on those websites. We are not responsible for the content, use, or the privacy policies or practices of Third Party Websites.

Our Platform may contain features that are operated by third-party services, such as social networking services. If you use such features, we may receive information that those services have collected about you (such as your name, email address, gender, locale, time zone, languages, social media profile URL, personal website URL, biographical information, contacts, birthday, photo, list of devices, education history, work history, hometown, interests, current city, political views, favorite athlete and teams, relationship status and information, religion, name of significant other, certain security settings information, and other such information). We do not control these third parties’ tracking or collection technologies or how they may be used. If you have any questions about the information provided to us by these third-party services, you should contact the responsible third-party service provider. We may use and disclose information we collect from these third-party service providers consistent with other information we collect about you under this Privacy Policy.

We may also combine information collected from third parties with information we collect from you, and other information collected from cookies, web beacons, and other technologies.

Data Retention and Security 

We take the security of your personal data seriously. To that end, we keep your data only as long as necessary to fulfill the purposes outlined in this Privacy Policy. Although no method of transmission over the internet is completely secure, and we cannot guarantee absolute security of your data, we attempt to prevent any unauthorized access or breach of our systems by following industry standard practices. In the event of a data breach, we will take all appropriate measures to address the situation and notify users as required by law.

If you are a resident of the European Union (“EU”) or United Kingdom (“UK”), you have the right to access, modify, or delete your personal data under the General Data Protection Regulation (“GDPR”). You also have the right to restrict or object to certain types of data processing.

Residents of the United States may have similar rights under federal or state consumer privacy laws, such as the California Consumer Privacy Act (“CCPA“), and other similar laws. CCPA provides, among other things, the right to request the deletion or disclosure of personal information collected within the past 12 months.

Cookies and Tracking Technologies 

We use cookies to enhance user experience on our Platform. Functional cookies store your preferences, analytical cookies help us improve Platform performance, and targeting cookies personalize your experience. You can control the use of cookies through your browser settings, but disabling cookies may affect the functionality of the Platform. In addition to cookies, Motiv may utilize other tracking technologies, including but not limited to pixels and web beacons, to monitor user interactions within the Platform. These technologies enable us to improve user experience and gather data for analytical purposes.

GDPR Compliance 

If you are located in the EU or the European Economic Area (“EEA”), your personal data is processed in accordance with GDPR. As the “data controller” of the personal data we collect through the Platform, we determine the purposes and methods of its processing. We process your personal data based on one or more legal bases, including:

(i)      your consent, which you provide when you explicitly agree to specific uses of your data; 

(ii)     the necessity of processing to fulfill a contract, such as providing services or processing payments; 

(iii)    our legitimate interest, when it is required to improve our services or secure the Platform, as long as these interests are not overridden by your rights and freedoms; and 

(iv)    compliance with legal obligations, such as record-keeping or regulatory requirements.

Under the GDPR, you have several rights regarding your personal data. You have the right to access your personal data and understand how it is processed, the right to correct any inaccuracies, the right to request the deletion of your data when it is no longer needed or if you withdraw your consent, and the right to restrict how your data is processed under certain conditions. You also have the right to receive your personal data in a structured, machine-readable format for transferring to another service provider (data portability) and the right to object to specific processing activities, such as for direct marketing or when processing is based on our legitimate interests.

School and Organizational Intellectual Property 

By creating an account, joining a school or organization, or placing an order through Motiv, you represent and warrant that you have the authority to use and authorize the use of any school names, organization names, team names, logos, mascots, or other branding elements submitted or selected in connection with your use of the platform.

You grant Motiv a limited, non-exclusive, royalty-free license to use such branding solely for the purpose of operating the platform, producing merchandise, and providing related services, whether on a school-wide, organization-wide, or program basis.

All school and organizational branding remains the property of its respective owner. Motiv does not claim ownership of any such intellectual property.

Motiv relies on the representations of schools, organizations, coaches, administrators, and other authorized representatives regarding permissions and is not responsible for disputes arising from unauthorized use of submitted or selected branding.

Changes to This Policy 

We reserve the right to modify this Privacy Policy at any time. When changes are made, we will update the effective date at the top of this page. We recommend you review this Privacy Policy regularly to stay informed of any updates. If significant changes are made, we may notify you via email.

Children's Privacy Policy

This Children’s Privacy Policy supplements our general Privacy Policy (“Privacy Policy”) and applies specifically to the collection, use, and disclosure of personal information from children in the United States under the age of 13 (“child” or “children”). Capitalized terms used but not defined in this Children’s Privacy Policy have the same meaning as they do in the Privacy Policy. Any terms defined in COPPA have the same meanings when used in this Children’s Privacy Policy.

Currently, no third-party operators use our Platform to collect personal information about children. If any third-party operators collect or maintain information through the Platform, their contact details will be provided.

Parental Rights

Parents have the right to review and request deletion of their child’s personal information, refuse further collection or use of their child’s personal information, or agree to the collection and use of their child’s information but refuse disclosure to third parties (unless necessary for the service).

Parents can exercise these rights by logging into their child’s account through the homepage or contacting us at Connect@theMotivapp.com. We will not require a child to disclose more information than is reasonably necessary to participate in an activity on the Platform.
